Service Description
We register your design/logo and business/product name with the Puerto Rico Department of State to provide you with the greatest legal protection. When you register your trademark, you are entitled to compensation, injunctions (e.g., cease and desist orders), expenses, attorney's fees, and other benefits. The cost of this service covers one class of goods/services. Note: The price does NOT include the filing fee for the trademark registration application with the Department of State ($225 per class). You can pay this fee directly once we begin the registration process and contact you to arrange payment. Services included: 1. Unlimited consultation on the subject. 2. Initial call of up to 1 hour for general guidance. 3. Search of your trademark in official records to avoid legal problems due to the likelihood of confusion with another trademark. 4. Drafting of the report and filing of the trademark registration application. 5. Processing before the Registry of Trademarks and Trade Names of the Puerto Rico Department of State. 6. Comparison of your trademark with previously registered trademarks and pending applications. Simple likelihood of confusion analysis. 7. Responding to any communication regarding non-substantive aspects of the trademark registration application. 8. Updates on the status of the trademark registration application. 9. Monitoring the process from start to finish. 10. Sending a digital copy of the Trademark Registration Certificate once it is registered. Terms: 1. Registering a trademark that has not been used in interstate commerce in Puerto Rico incurs an additional cost. This cost will be provided when notification of trademark use is required by the Puerto Rico Department of State. 2. This service does not include appeals, refusals, or any other action requested by the examining officer that was not included in the original application. The cost for any action excluded from this service will be provided to you in a timely manner. 3. The registration process can take 3-12 months to complete.
Cancellation Policy
1. Law Office PR reserves the right to cancel the service at our sole discretion, in which case you will receive a full refund. 2. You are responsible for logging in on the scheduled day and time, and we will only wait 10 minutes. If you do not appear for your appointment without prior notice or rescheduling, your payment will not be refunded. 3. Even after receiving a legal consultation, we reserve the right to accept your case and represent you. 4. This consultation does not establish an attorney-client relationship. Such a relationship will only be established when: any potential conflicts of interest are reviewed and eliminated; a representation agreement is formalized; and you receive confirmation from one of our attorneys regarding your acceptance of the representation agreement, its scope, and your consent.
